- PendingT1 The Magnolia is situated within a very restricted residential garden, where the crown occupies a substantial proportion of the available space. The proposed works are repeat cyclical crown management, following previously approved works under AT 2020 0248 rather than a new or substantially different intervention. T1 Magnolia - proposed works Undertake a selective crown reduction, shortening branches by up to 1.5 metres from the existing crown tips across the upper and lateral crown, pruning to suitable live lateral branches while retaining a balanced crown form and adequate foliage. Avoid topping and indiscriminate cutting. Carry out the works in accordance with BS 3998 2010. Management intention - Review the crown at approximately five year intervals, with further pruning subject to the trees condition, regrowth and any notification or consent requirements applicable at that time. This approach will enable the Magnolia to be retained successfully within its restricted garden setting and will maintain its contribution to the character and amenity of the Conservation Area.Lower Flat 10 Somerset Court Mount Pleasant Road Brixham TQ5 9RXReceived 04 Oct 2026TreesAT/2026/02771.36 km from centreTorbay council

- PendingTree ID: T1 - Beech (Copper Beech) as identified under the Modified Schedule of TPO 2025.005. Proposed Work: Sectional dismantle to ground level and reinstate 1x Ginkgo biloba standard at the southern end of the grounds as indicated on the attached sketch plan. Reasons for Work: Incompatible Spatial Relationship & Mutually Agreed Pruning Failure: The main stem of this 50ft tree stands within a critical 1.2 metres of the residential property, overhanging the building ridge line by 6-7 metres. In Case AT/2026/0070 (Page 2-3, Sec 8, 11), the Council's Tree Officer explicitly ruled that the pruning works required to achieve safe, long-term structural clearance from the roof would remove over 30% of the leaf-bearing volume, risk fatal 'sun scorch damage' to this thin-barked species, and invite decay. Because the physical proximity to the house is absolute, and the council formally agrees that the pruning required to clear the building is physiologically destructive to the asset, long-term retention under BS 3998 is entirely unviable. Arithmetic Defect in Standalone Amenity Scoring (True Score: 14):The TPO was confirmed subject to modifications on 12th December 2025, legally isolating the Beech tree as 'T1'. The collective evaluation score was benchmarked at the absolute minimum threshold of 15 for each property, but inflated by artificially combining data across two properties where the protected trees on each site are situated some 200 feet apart. In the confirmation report (Page 3), the council explicitly accepted the applicant's formal objection regarding local tree density and issued a 1-point reduction (-1) to the category score. Because the modified order must protect T1 on its standalone merits, its true standalone arithmetic score is 14. Torbay Council's local framework dictates a minimum score of 15 to justify a TPO. T1 falls below the threshold and its ongoing retention is procedurally unjustified. - ApprovedTree Surgeon consulted: Greg Laywood, Clear View Tree and Hedge Services Ltd. Recommendation for a cyclical application to undertake cyclical crown reductions (3/5 yearly) on a Holme oak tree located within the rear garden of the property, with the height reduced to 1m below an overhead telephone cable which has been enveloped within the canopy. All as previous application ref: AT/2021/0099/TPO, approved 11th May 2021. The tree also overhangs the access road to North Fields Industrial Estate which is used by multiple companies, serviced by large lorries and delivery trucks. A reduction on the canopy width will bring the canopy within the property boundary whilst maintaining the shape and proportion of the tree. The works are required to prevent damage to the telephone cable, and to prevent damage to the tree and vehicles as the delivery vehicles access/egress the Industrial Estate . All works will be undertaken by a Tree Surgeon in conformance to BS3998 "Recommendations for Tree Work 2010".3 North Hill Close Brixham TQ5 8RXReceived 13 Aug 2026Decided 11 Oct 2026TreesAT/2026/02172.06 km from centreTorbay council

- RefusedBeech T2 specifications 1) Reduce the sides of the southern, western and northwestern aspects of the crown by 2-3m with a 100mm maximum cut diameter. This northwestern crown radius will reduce from approximately 7m to 5m. The southern crown radius will reduce from approximately 7m to 5m. The western crown radius will reduce from approximately 14m to 11m. 2) Remove the lowest limb in the southern crown - approximately 200mm in diameter Beech T2 reason for works (Tree report must be read) Previous root disturbance is suspected - potentially destabilising the rooting system. The tree has a significant crown bias to the west. Pruning will reduce the loading on the root system and therefore reduce the likelihood of it uprooting. Tree stands within falling distance to parking. The lowest limb is struck by delivery vehicles, there are limited options for branch reduction. Beech T3 specifications 1) Reduce the sides of the northern, eastern and southern crown aspects by 2.5m ? use a 100mm maximum cut diameter. The crown radius will reduce from approximately 8m to 5.5m. 2) Reduce the top of the tree by 1.5m - use a 75mm maximum cut diameter. The height of the tree will reduce from approximately 19.5m to 18m. Beech T3 reason for works (Tree report must be read) The base of the main stem is decayed. - ApprovedPlease refer to plan no: 2015.001 - T4 Maple tree for position reference + identification information We wish to request permission for a professional tree surgeon to create a light crown lift of approx 2 metres removing a small number of secondary branches to maintain a balanced canopy + ground level clearance + selectively reduce lateral spread by no more than 1 metre to retain existing framework whilst reducing footpath overhang + promoting trees' existing form. The intention is to retain trees' natural character + encourage new healthy growth.5 Douglas Avenue Brixham TQ5 9ELReceived 08 Apr 2026Decided 05 Jul 2026TreesAT/2026/01011.21 km from centreTorbay council
- ApprovedG1 - Cypress Suggested Works: Dismantle southernmost tree (closest to residential property) in stages to near ground level, reduce height of remaining two trees by 2 metres, Maximum Diameter of Cuts (MDC) 50mm. Trim all round to shape. Rationale: The southernmost tree of the group is clearly in a declining state - there is dieback in the canopy plus separation between the stems on the southern side. Additionally, the tree is growing within 50cms of the residential property. With limited pruning options available, due to the tree's species and form, and the current state of the tree we believe that the tree is not suitable for retention and removal is the only viable option. Reducing the two remaining trees is to reduce loadings on the newly exposed stems following the removal of the adjacent tree in G1.7 Northfields Lane Brixham TQ5 8RSReceived 06 Apr 2026Decided 02 Jun 2026TreesAT/2026/01002.23 km from centreTorbay council

- ApprovedWe intend to prune our Mimosa Tree at the front of the property to keep it well maintained and prevent it from protruding significantly into the Highway. This also obstructs visibility for those using the courtyard which is a safety concern. Please see image of tree and location plan. NB: Tree is the larger of the two canopies depicted in the front garden on the plans (SE corner). The proposed works consist of a selective crown reduction to the outer extremities of the canopy. It is intended to reduce the length of the overextended branches to approx 1.5-2m from the branch tips equating to an overall reduction of no more than 20-30% of the crown volume.Higher Alston Farmhouse Alston Lane Brixham TQ5 0HTReceived 24 Mar 2026Decided 05 May 2026TreesAT/2026/00904.22 km from centreTorbay council
- Approved with conditionsOak T1 - Proposed work: Fell. Justification: The tree exhibits a pronounced lean with a restricted rooting environment, resulting in reduced structural stability. Removal is appropriate due to limited long-term retention potential. Natural regeneration is generally expected and seen as a suitable strategy for this species. Oak T2 - Proposed work: Re-coppice to previous points. Justification: Evidence of decay within the lower stem. Re-coppicing helps restore a stable coppice stool and keeps the tree contributing to the hedge structure. Natural regeneration is generally expected and seen as a suitable replacement strategy for this species. Oak T3 - Proposed work: Fell. Justification: Significant lean combined with constrained rooting space, limiting safe future development. Removal is appropriate given the low long-term viability. Natural regeneration is generally expected and seen as a suitable strategy for this species. Oak T4 - Re-coppice to previous points. Justification: Decay is present in the lower stem. Re-coppicing helps restore a stable coppice stool and keeps the tree contributing to the hedge structure. Natural regeneration is generally expected and seen as a suitable replacement strategy for this species. Sycamore T5 - Proposed work: Crown reduction by up to 2m, maintaining natural form. Justification: Works intended to manage crown spread and maintain appropriate clearance while retaining tree health and amenity value. The tree lost its stability and possibly some roots when the neighbouring wall collapsed last year. Oak T6 - Proposed work: Remove the lowest-order branch only. Justification: Minor branch removal required to facilitate access for larger vehicles. The branch is of small diameter with an acceptable 3:1 ratio, and removal will not adversely affect the tree's form or vitality.Rock Bank West Higher Manor Road Brixham TQ5 8HAReceived 23 Mar 2026Decided 17 May 2026TreesAT/2026/00881.72 km from centreTorbay council

- ApprovedThe reason for the tree removal request is that the location and size/type of tree are incompatible. The tree is a Mexican Fan Palm which are fast growing, with heights up to 100 feet possible. The tree is located only a few metres from 2 properties, and specifically located adjacent to a main road (Ranscombe Road, a major access road to the Marina/Berry Head) with a raised wall supporting surrounding properties. The tree is already causing issues for a small retaining wall (see photo attached) and the damage to the immediate location will only get worse such that it is believed that removal will inevitably be required at some point, so it makes sense to do this sooner rather than later (thereby reducing impact, cost and technical issues). We have commissioned a review by a professional local company (Advanced Tree Care, Brixham) who have visited the site and clarified that tree management/maintenance options were strictly limited due to the tree type, such that it is only possible to remove dead leaves for appearances rather than control growth. There is another palm tree within a metre of the Fan Palm and the plan is to leave that one, letting it flourish with the improved light such that the visual impact of losing the Fan Palm is diminished over time.35 Ranscombe Road Brixham TQ5 9UUReceived 02 Mar 2026Decided 13 Apr 2026TreesAT/2026/00670.94 km from centreTorbay council
